Copyright & Unauthorised Use

All images created by the Photographer (Jamie Leonard/Wild Heart Studios) are protected by copyright and remain the property of the Photographer at all times.

Any use of these images by individuals, businesses, or third parties who have not purchased a licence is strictly prohibited.

Unauthorised use includes, but is not limited to:

Copying, downloading, or screenshotting images from websites or social media
Using images for personal or commercial purposes without permission
Sharing, reproducing, or distributing images in any format
Using images for business, advertising, or promotional purposes
Using images to promote products, services, or third parties
Creating derivative works, including artwork, edits, composites, or merchandise
Using images for artificial intelligence purposes, including training models or generating AI content
Creating NFTs or any blockchain-based assets

The Photographer actively monitors unauthorised use of images.

Any unauthorised use will result in a fee being charged, which may be significantly higher than standard licensing rates. The Photographer reserves the right to pursue legal action, including recovery of damages, licensing fees, and associated legal costs.

Photography Terms & Conditions of Sale

1. Ownership & Copyright

All photographs remain the intellectual property and copyright of the Photographer (Jamie Leonard/Wild Heart Studios) at all times, in accordance with the Copyright, Designs and Patents Act 1988. No ownership rights are transferred to the Client upon purchase.

2. Permitted Use (Personal Licence)

Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the purchased images for personal use only. This includes:

Printing for personal display
Sharing on personal social media accounts (with credit where possible)

3. Prohibited Use

The Client may not, under any circumstances:

Use any images for commercial purposes, including advertising, marketing, or promotional materials
Sell, license, sublicense, or otherwise distribute the images to any third party
Use purchased images to promote any product, service, or business without prior written permission
Print images on products for sale, including any derivative works of art, without prior written consent
Edit, alter, manipulate, or digitally modify the images in any way without prior written consent
Digitally alter the appearance or structure of any dog in a way that is misleading or untruthful
Use images of other people’s dogs in a defamatory, harmful, or misleading manner
Enter images into competitions, contests, publications, or exhibitions without prior written permission
Remove or alter any watermark, metadata, or copyright information
Create, mint, or sell NFTs (non-fungible tokens) using the images
Use the images for artificial intelligence purposes, including but not limited to training models, generating AI art, or any machine learning applications
Any commercial use or other use outside the scope of the personal licence requires a separate written agreement and may be subject to additional licensing fees.

Any unauthorised use of the images will be considered a breach of these Terms and Conditions and may result in legal action.

4. Payment Terms

All images must be paid for in full prior to delivery. Prices are subject to change without prior notice, but confirmed bookings will be honoured at the agreed rate.

5. Delivery

Images will be delivered in digital format unless otherwise agreed. Delivery timescales will be communicated at the time of purchase.

6. Refunds & Cancellations

Due to the nature of digital products, all sales are final. Refunds will not be issued once images have been delivered, except where required by law.

7. Photographer’s Rights

The Photographer reserves the right to:

Use images for portfolio, website, social media, competitions, and promotional purposes unless otherwise agreed in writing
Refuse service or cancel orders at their discretion

8. Client Responsibility

The Client is responsible for ensuring that images are used in accordance with these terms. Any misuse may result in legal action.

9. Liability

The Photographer will not be held liable for any indirect or consequential loss arising from the use of images.

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Scotland.

Digital Image Licence

Upon full payment, the Client is granted a non-exclusive, non-transferable licence to use the digital images for personal use only.

Permitted use includes:

Downloading, saving, and storing the images
Printing images for personal use
Sharing images on personal social media accounts (credit to the Photographer is appreciated)

The licence does not permit:

Any commercial use, including but not limited to advertising, marketing, promotion, or use in connection with any business, product, or service
Selling, licensing, sublicensing, or distributing the images to any third party
Printing images on products for sale or creating derivative works for commercial purposes
Providing images to brands, businesses, publications, or other organisations without prior written consent
Entering images into competitions, contests, publications, or exhibitions without prior written permission
Editing, altering, retouching, or applying filters to the images without the Photographer’s consent
Digitally altering the appearance or structure of any dog in a way that is misleading or untruthful
Using images of other people’s dogs in a defamatory, harmful, or misleading manner
Removing or altering any watermark, metadata, or copyright information
Creating, minting, or selling NFTs using the images
Using the images for artificial intelligence purposes, including but not limited to training models, generating AI art, or any machine learning applications

This licence is granted to the Client only and may not be transferred, shared, or sublicensed to any third party.

The Photographer retains full copyright and ownership of all images at all times. Any use outside the scope of this licence requires prior written agreement and may be subject to additional fees.

Image Removal Requests

Wild Heart Studios respects the privacy of individuals featured in images.

If you spot a photo displayed in the online gallery, portfolio, or social media that you are in and would prefer it not to be shared, just get in touch—I’m always happy to review and remove images where appropriate.
